Terms of Service

These Terms of Service ("Terms") govern your access to and use of PillowFare, including the website at pillowfare.com, our APIs, and any related services (collectively, the "Service"), provided by PillowFare LLC, a Montana limited liability company ("PillowFare," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, don't use the Service.

1. The Service

PillowFare is a travel meta-search and booking facilitator. We aggregate listings, prices, and availability from third-party travel suppliers ("Travel Partners") โ€” including hotels, airlines, car-rental companies, online travel agencies (OTAs), and experience/attraction providers โ€” and present them so you can compare options in one place.

Important: when you click through to book, the booking contract is between you and the Travel Partner, not PillowFare. We're a search and referral platform, not the hotel, airline, OTA, or rental company.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a booking. By using the Service you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Your account

3.1 Account creation

You can create an account with an email address and password, or sign in using a passkey (WebAuthn). You agree to provide accurate, current information and to keep it updated.

3.2 Account security

You're responsible for keeping your password and passkeys secure and for all activity that occurs under your account. Notify us at [email protected] immediately if you suspect unauthorized access.

3.3 One account per person

You may not create multiple accounts to circumvent rate limits, abuse promotions, or evade enforcement actions.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Scrape, crawl, or harvest content, listings, or user data without our written permission.
  • Interfere with or disrupt the Service, including by overwhelming our infrastructure, exploiting bugs, or attempting to bypass rate limits.
  • Attempt to gain unauthorized access to any accounts, systems, or networks.
  • Use bots, automated scripts, or other automated means to interact with the Service except through APIs we explicitly provide.
  • Misuse the contact form or contact channels to send spam, phishing attempts, or harassment.
  • Resell, sublicense, or redistribute the Service or its content without our permission.
  • Use the Service to violate the intellectual property, privacy, or other rights of others.

5. Bookings through Travel Partners

5.1 Partner terms apply

Every Travel Partner has its own terms, cancellation rules, fare rules, and policies. When you book through a Partner, you also agree to that Partner's terms. Read them before completing a booking.

5.2 Accuracy

We do our best to display accurate availability, prices, and descriptions sourced from our Travel Partners, but we cannot guarantee that information is current or error-free. The final price, terms, and availability are confirmed by the Travel Partner at the time of booking.

5.3 Cancellations, changes, and refunds

Cancellations, modifications, and refunds are governed by the Travel Partner's policies. PillowFare doesn't process refunds for bookings made through Partners โ€” you must contact the Partner directly for those.

5.4 No travel advice

PillowFare doesn't provide travel, immigration, visa, health, or insurance advice. You're responsible for ensuring you meet all requirements to travel to your destination.

6. Payments and stored payment methods

6.1 Payment processing

Payments are processed by Stripe, Inc., our payment processor. By submitting payment information you also agree to Stripe's terms.

6.2 Stored payment methods

You may save credit cards, Apple Pay, Google Pay, or PayPal as payment methods on your account for future bookings. These are stored as tokens by Stripe โ€” PillowFare doesn't see or store full card numbers. You can remove a saved method at any time from your Billing page.

6.3 Authorization

You authorize PillowFare and Stripe to charge your saved payment method for bookings you place through the Service, including applicable taxes and fees imposed by Travel Partners.

6.4 Disputes

If you believe a charge is incorrect, contact us within 60 days at [email protected] before initiating a chargeback so we can work to resolve it.

7. Rewards program

The PillowFare rewards program (if and when active) is a discretionary benefit. Points have no cash value, are non-transferable, and may be modified, expired, or discontinued at our reasonable discretion with notice. Earning and redemption rules are published on the Rewards page.

8. User content

If you submit content to PillowFare (for example, through the contact form or a future review feature), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content for the purpose of operating and improving the Service. You retain ownership of your content.

You represent that you have the right to submit the content and that it does not infringe any third-party rights.

9. Our intellectual property

The Service โ€” including software, design, logos, copy, and the PillowFare name โ€” is owned by PillowFare LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial travel-planning purposes, subject to these Terms.

Third-party trademarks (e.g. Booking.com, Expedia, Stripe, OurAirports, GeoNames) are the property of their respective owners and used here for identification only.

10. Third-party links and services

The Service contains links to and content from third parties. We're not responsible for the availability, content, or practices of any third-party site, and your interactions with third parties are between you and them.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

We don't warrant that the Service will be uninterrupted, error-free, or secure; that defects will be corrected; or that prices, availability, or listings will be accurate or complete.

12. Limitation of liability

To the maximum extent permitted by law:

  • PillowFare will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, or loss of goodwill, arising from or related to your use of the Service.
  • Our total aggregate liability for all claims related to the Service will not exceed the greater of (a) the total fees you paid to PillowFare in the 12 months before the claim, or (b) one hundred U.S. dollars (US $100).

Some jurisdictions don't allow these limitations, so they may not apply to you in full.

13. Indemnification

You agree to indemnify and hold harmless PillowFare LLC, its officers, members, employees, and agents from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party right.

14. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or if we discontinue the Service. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, miscellaneous) will continue to apply.

15. Governing law and dispute resolution

15.1 Governing law

These Terms are governed by the laws of the State of Montana, USA, without regard to its conflict-of-laws principles.

15.2 Venue

Subject to Section 15.3, you and PillowFare agree to the exclusive jurisdiction of the state and federal courts located in Montana, USA, for any dispute that isn't subject to arbitration.

15.3 Informal resolution

Before filing any claim, you agree to first contact us at [email protected] with a written description of your dispute and to allow 60 days for good-faith resolution.

15.4 Class action waiver

To the extent permitted by law, you and PillowFare each waive the right to bring or participate in any class, collective, or representative action against the other.

16. Changes to these Terms

We may update these Terms from time to time. The "Effective" date at the top of the page reflects the current version. For material changes, we will notify you by email or a prominent notice on the Service. Continued use after the effective date constitutes acceptance.

17. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and PillowFare regarding the Service and supersede any prior agreements.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for delays or failures due to causes beyond reasonable control (natural disasters, war, pandemic, government action, infrastructure outages, etc.).
  • Headings. Headings are for convenience only and don't affect interpretation.
